Adnotationes In Ius Canonicum. This book follows the protection of religious ministers in armed conflict from its roots in religious law to the present-day status of religious personnel in international humanitarian law. Considering the example of German chaplaincy, he also examines interactions of international protection with the national status.

Against this background, the chapter assesses the (loss of) protection of the Islamic State’s religious personnel in Iraq and Syria.

Under international humanitarian law religious personnel must be protected against direct military attack. This basic principle, rooted in the humanitarian function of religious personnel on the battlefield, also applies to Islamic chaplains with the organized armed group Islamic State. Against this background, the chapter assesses the (loss of) protection of the Islamic State’s religious personnel in Iraq and Syria. It distinguishes between such chaplains who are formally integrated into the organized armed group (IS-chaplains), and such civil chaplains who are not (IS-civil chaplains).

It was signed at The Hague, Netherlands on 14 May 1954 and entered into force on 7 August 1956. As of September 2018, it has been ratified by 133 states.

If one assumes that war is inevitable, in any particular situation due to the severe viewpoints of the opposing factions, or in general as a destructive result of our very humanity, then one must prepare for it. Weapons of war must be built, and soldiers must be trained. During this process of training brings with it a choice. Each soldier is told about the risk involved with becoming a member of the armed forces, and has the option to not take part in the militarised activity
